Preamble

 

The General Terms and Conditions of Sale (hereinafter « TCS ») are available to Customer (hereinafter « Customer ») by the company PARIS SEINE a société par actions simplifiée, having its registered office at 83, boulevard de Sébastopol 75002 Paris, registered with the Paris Trade & Companies Register under No. 400 665 469 (hereinafter the “PARIS SEINE”).

PARIS SEINE has taken out third-party insurance with The Shipowners’ Club, situated at 10 Whitechapel High Street, Londres E1 8QS, Royaume-Uni.

 

PARIS SEINE is specializing in organizing functions on the Seine for individuals and businesses (hereinafter the “Services”).

 

These TCS govern the contractual relations (hereinafter the “Agreement”) between PARIS SEINE and the Customer (hereinafter jointly referred to as the “Parties” and individually the “Party”).

 

The TCS are systematically communicated to each Customer before entering into an Agreement. Consequently, placing an order for Services (hereinafter the “Order”) implies the Customer’s full and unconditional adherence to said TCS, to the exclusion of all other documents.

 

The Services proposed by PARIS SEINE are intended for consumers in accordance with the definitions set forth in the French Consumer Code.

 

It is specified that in accordance with Article L. 221-28-12° of the Consumer Code, the right of withdrawal does not apply to the Services provided by PARIS SEINE.

 

Article 1 – Booking and Payment

 

All tours and excursions must be booked in advance.

 

Booking any of our services implies the acceptance of these General Terms and Conditions of Sale. Bookings will only be considered to be effective upon :

 

  • The acceptance of the booking by PARIS SEINE ;
  • The receipt of the payment ;
  • The receipt of a confirmation mail ;

 

Article 2 – Price

 

The prices are firmed and definitive.

 

The prices include all the services indicated in the description of each service. The prices mentioned are quoted per person and in euros, and includes VAT.

 

Article 3 Cancellation policy

 

3.1 Cancellation by the Client

 

The Client can cancel partially or totally its Order subject to the following conditions:

 

Any cancellation shall be notified to QUAIS DE SEINE, in writing.

 

The date of the cancellation shall be the determined date for the application of the following cancellation fees:

 

Date of the cancellation of the Service

 

More than 72h before the date of the Service

 

Between 72h and 24h before the date of the Service

 

Less than 24h before the date of the Service

3.2 Amendment by the client 

 

Any change request must be send to PARIS SEINE by mail at  contact@parisseine.com at least 6 hours before the beginning of the Service.

3.3 Cancellation by PARIS SEINE

 

PARIS SEINE reserves the right to cancel the Service at any time in the event of failure to make full or part payment. Any advance will be retained.

 

Being that cruises are subject to the rules of navigation, PARIS SEINE reserves the right to determine whether or not rivers are navigable. Cruises may be canceled or modified at any time, (in particular time and place of the departure) beginning from the date of their booking, including on the day scheduled for departure, in accordance with the above-mentioned rules, or in the event of poor weather which may endanger the safety of the passengers on these cruises.

 

In case of unseaworthiness (boat is held ashore), PARIS SEINE will grant a reduction of fifteen per cent (15%) on the price exclusive of taxes of the charter part of the Service.

 

PARIS SEINE reserves the right to cancel or change certain tours without notice if this is necessary to insure the comfort or safety of passengers, in particular in the event of force majeure, strikes, natural disasters, cultural events, administrative decisions or unexpected closures. Force majeure refers to any event outside the control of the affected party, of an unpredictable, irresistible and insurmountable nature, which prevents PARIS SEINE from performing all or part of its obligations under this contract.

 

Should the Service be wholly canceled, PARIS SEINE will not be held liable for indirect and collateral damages that shall result from this cancellation.

 

In case of cancellation, even due to force majeure as defined above, the CLIENT could postpone the Service to another date for eighteen (18) months, subject to availability.

 

Article 4 – Liability

 

Within the limits provided by governing law, PARIS SEINE cannot be held liable for failure to perform the Agreement in the event of force majeure, as defined in Article 1218 of the French Civil Code and French case law, or in the event of damage caused by a third party outside its control or due to improper or non-compliant use of the Services by the Customer, in breach of PARIS SEINE instructions.

 

Personal items

 

PARIS SEINE and its providers cannot be held liable for the loss or theft of personal items and we are not obliged to find or to return personal items.

 

All costs incurred with regard to lost or stolen personal items shall be borne by the customer.

 

Customer delay

 

The Client, or the entire group, must be present at the point of embarkation no later than fifteen (15) minutes before the planned departure time.

 

The departure time of the boat shall not be postponed.

 

Security

 

In the light of the worldwide health-care crisis context COVID 19 and the pandemic that has resulted, PARIS SEINE has introduced health measures.

 

The detail of theses measures is developed in the Health Protocol attached to this TCS.

 

The Heath Protocol may be subjected to amendments in order to monitor the evolution of the legislative framework and the decisions that will be adopted by the managers.

 

The customer undertakes to behave in a way that is not contrary to theses health measures, the rules of common sense and follows the current laws and regulations.

 

PARIS SEINE reserves the right to disembark any passenger who violates these measures / the regulations and/or whose behavior is clearly likely to put other passengers, the captain or a third party at risk, without this passenger being able to claim compensation or reimbursement.

 

We would like to remind you that alcohol abuse is dangerous for your health.

 

PARIS SEINE cannot be held liable for any behavior or accidents that may occur to customers while intoxicated or under the influence of drugs, or for any damage these customers may cause.

 

The Client is solely responsible for the behavior of his guests.

 

PARIS SEINE reserves the right to bill the Customer for any material damage caused to the boat or its equipment by himself of his guests.

 

Animals

 

Animals are not permitted on board apart from guide dogs if a guide dog card is presented.

 

Article 5 – Insurance 

 

PARIS SEINE has an insurance contract with The Shipowners’ Club located at 10 Whitechapel High Street, Londres E1 8QS, UK;

 

This insurance contract covers the financial consequences of the civil liability PARIS CITY VISION may incur as a result of its activities.

 

Article 6– Personal data

 

The provisions concerning the protection of personal data set forth in the French Data Protection Act of 6 January 1978, as amended and the European Regulation on the protection of personal data of 27 April 2016 which entered into force on 25 May 2018 (“GDPR”) are found in the document attached entitled “Privacy Policy”, accessible on the Website.

 

Article 7 – Amendment and nullity of the contract

 

Should any term of the Contract be, for any reason whatsoever, invalid or unenforceable, the remaining provisions shall not be affected by such invalid or unenforceable provision. 

 

The Parties shall make a good faith effort to replace the enforceable provision by an equivalent one.

 

Amendments to the present Contract shall be made by mutual written agreement of the Parties. 

 

Article 8 Warranties and claims

 

PARIS SEINE ensures the compliance of the Service to the Contract and the Client has the possibility to make a request under the legal warranty of conformity as stipulated in the Section L.217-1-4 and seq of the French Consumer Code or under the legal warranty covering all the consequences of the hidden  or other defects of the goods sold as stipulated in the section 1641 and seq of the French civil code. 

 

This warranty shall cover all apparent or hidden defects detected originating in a defect in design or execution of the services ordered.

 

The Client shall inform PARIS SEINE of these apparent or hidden defects within 48 hours of receiving the services.

 

Possible apparent or hidden defects recorded by PARIS SEINE will give rise to commercial proposal (reimbursement, rectification, credit note) within fifteen (15) days upon the statement of the defect.

 

This warranty is limited to the reimbursement of the services actually paid by the Client. This warranty is excluded in case of delay or inexecution due to a force majeure case as defined in Article 4.

 

Article 9 Governing law and competent courts

 

These TCS are governed and interpreted in accordance with French law, without taking into account conflicts of law.

 

If any provision of these TCS or its application to any person or circumstance is judged null and void, this nullity will not concern the other provisions or applications of these TCS, which will remain in force, independently of the provision judged null and void. To this end, the provisions of these TCS are declared stand-alone.

 

In the event of a dispute arising when interpreting and/or performing these TCS or in relation to these TCS, the User can decide to seek to settle said dispute with the Company through traditional mediation proceedings or any other alternative means of dispute settlement. The User is informed that:

 

To allow a dispute to be examined by the mediator, the User must justify that he has made a written claim to the Company or keep written proof of measures taken;

 

The request must be founded and lawful.

 

The User can bring the matter before the mediator within a maximum period of one year following the Company’s written claim.

 

Finally, in the event that this mediation procedure fails or if the User wishes to bring proceedings, the French Code of Civil Procedure will apply.

 

STRENGTHENED HEALTH PROTOCOL FOR A SAFE AND QUICK DISASTER RECOVERY

 

The following Protocol is established in the context of health crises COVID 19 in order to respond to the pandemic.

 

A number of measures has been taken to avoid contamination by the incoming streams (laundry, food products…) and in general, for the whole products delivered to the establishment:

 

  • Normal hygiene measures are respected;
  • Frequency of hand cleaning of the staff has been increased;
  • The AC and the controlled ventilation are regularly checked and cleaned;
  • The delivered products (except fresh products) are cleaned in a specific zone before entering and being stocked in the establishment.
  • Proper, effective surface cleaning and disinfection plan regarding to the locations, the equipment, handles, buttons of doors, railings, and more generally of any object of surface that may have been contaminated (in contact with hands). The cleaning frequency of surface, equipment, supports and utensils has been increased.
  • Hydroalcoholic solution is systematically made available to the clients at the entry of the establishment.
  • The whole staff will be equipped by gloves and masks during the order picking and the service.
  • The bathroom will be disinfected every hour.
  • Social distancing rules for the public will be defined and respected, based on 1 linear meter between two tables. The guests limit by table is 10 persons, forming a homogeneous group (friend, family) predetermined.
  • Spacing measures between people are through posting, road marking, or oral instructions.
  • Public flow organization is managed to limit the crosses.
  • Places or moment of crosses as buffet or banqueting will be avoided or at least framed to avoid the clustering of clients and staff : limitation of the number of clients, onward march, change of cutlery service between each client.
  • Masks are compulsory for clients except when there are eating.
  • Menus will be displayed QR Code or laminated and clean between each handling.
  • Contactless payments (pre-payment, credit transfer, QR CODE..) will be preferred as pay-at-table.

 

This document and the advices about health measures are established on the basis of information available this date from WHO, ministries of health and work, and INRS.

 

It will be amended following the legislative framework and the news measures taken by the managers if necessary.

PARIS SEINE has taken out third-party insurance with The Shipowners’ Club, situated at 10 Whitechapel High Street, Londres E1 8QS, Royaume-Uni.

 

PARIS SEINE is specializing in organizing functions on the Seine for individuals and businesses (hereinafter the “Services”).

 

These TCS govern the contractual relations (hereinafter the “Agreement”) between PARIS SEINE and the Customer (hereinafter jointly referred to as the “Parties” and individually the “Party”).

 

The TCS are systematically communicated to each Customer before entering into an Agreement. Consequently, placing an order for Services (hereinafter the “Order”) implies the Customer’s full and unconditional adherence to said TCS, to the exclusion of all other documents.

 

The Services proposed by PARIS SEINE are intended for consumers in accordance with the definitions set forth in the French Consumer Code.

 

It is specified that in accordance with Article L. 221-28-12° of the Consumer Code, the right of withdrawal does not apply to the Services provided by PARIS SEINE.

 

Article 1 – Booking and Payment

 

All tours and excursions must be booked in advance.

 

Booking any of our services implies the acceptance of these General Terms and Conditions of Sale. Bookings will only be considered to be effective upon :

 

  • The acceptance of the booking by PARIS SEINE ;
  • The receipt of the payment ;
  • The receipt of a confirmation mail ;

 

Article 2 – Price

 

The prices are firmed and definitive.

 

The prices include all the services indicated in the description of each service. The prices mentioned are quoted per person and in euros, and includes VAT.

 

Article 3 Cancellation policy

 

3.1 Cancellation by the Client

 

The Client can cancel partially or totally its Order subject to the following conditions:

 

Any cancellation shall be notified to QUAIS DE SEINE, in writing.

 

The date of the cancellation shall be the determined date for the application of the following cancellation fees:

 

Date of the cancellation of the Service

 

More than 72h before the date of the Service

 

Between 72h and 24h before the date of the Service

 

Less than 24h before the date of the Service

3.2 Amendment by the client 

 

Any change request must be send to PARIS SEINE by mail at  contact@parisseine.com at least 6 hours before the beginning of the Service.

3.3 Cancellation by PARIS SEINE

 

PARIS SEINE reserves the right to cancel the Service at any time in the event of failure to make full or part payment. Any advance will be retained.

 

Being that cruises are subject to the rules of navigation, PARIS SEINE reserves the right to determine whether or not rivers are navigable. Cruises may be canceled or modified at any time, (in particular time and place of the departure) beginning from the date of their booking, including on the day scheduled for departure, in accordance with the above-mentioned rules, or in the event of poor weather which may endanger the safety of the passengers on these cruises.

 

In case of unseaworthiness (boat is held ashore), PARIS SEINE will grant a reduction of fifteen per cent (15%) on the price exclusive of taxes of the charter part of the Service.

 

PARIS SEINE reserves the right to cancel or change certain tours without notice if this is necessary to insure the comfort or safety of passengers, in particular in the event of force majeure, strikes, natural disasters, cultural events, administrative decisions or unexpected closures. Force majeure refers to any event outside the control of the affected party, of an unpredictable, irresistible and insurmountable nature, which prevents PARIS SEINE from performing all or part of its obligations under this contract.

 

Should the Service be wholly canceled, PARIS SEINE will not be held liable for indirect and collateral damages that shall result from this cancellation.

 

In case of cancellation, even due to force majeure as defined above, the CLIENT could postpone the Service to another date for eighteen (18) months, subject to availability.

 

Article 4 – Liability

 

Within the limits provided by governing law, PARIS SEINE cannot be held liable for failure to perform the Agreement in the event of force majeure, as defined in Article 1218 of the French Civil Code and French case law, or in the event of damage caused by a third party outside its control or due to improper or non-compliant use of the Services by the Customer, in breach of PARIS SEINE instructions.

 

Personal items

 

PARIS SEINE and its providers cannot be held liable for the loss or theft of personal items and we are not obliged to find or to return personal items.

 

All costs incurred with regard to lost or stolen personal items shall be borne by the customer.

 

Customer delay

 

The Client, or the entire group, must be present at the point of embarkation no later than fifteen (15) minutes before the planned departure time.

 

The departure time of the boat shall not be postponed.

 

Security

 

In the light of the worldwide health-care crisis context COVID 19 and the pandemic that has resulted, PARIS SEINE has introduced health measures.

 

The detail of theses measures is developed in the Health Protocol attached to this TCS.

 

The Heath Protocol may be subjected to amendments in order to monitor the evolution of the legislative framework and the decisions that will be adopted by the managers.

 

The customer undertakes to behave in a way that is not contrary to theses health measures, the rules of common sense and follows the current laws and regulations.

 

PARIS SEINE reserves the right to disembark any passenger who violates these measures / the regulations and/or whose behavior is clearly likely to put other passengers, the captain or a third party at risk, without this passenger being able to claim compensation or reimbursement.

 

We would like to remind you that alcohol abuse is dangerous for your health.

 

PARIS SEINE cannot be held liable for any behavior or accidents that may occur to customers while intoxicated or under the influence of drugs, or for any damage these customers may cause.

 

The Client is solely responsible for the behavior of his guests.

 

PARIS SEINE reserves the right to bill the Customer for any material damage caused to the boat or its equipment by himself of his guests.

 

Animals

 

Animals are not permitted on board apart from guide dogs if a guide dog card is presented.

 

Article 5 – Insurance 

 

PARIS SEINE has an insurance contract with The Shipowners’ Club located at 10 Whitechapel High Street, Londres E1 8QS, UK;

 

This insurance contract covers the financial consequences of the civil liability PARIS CITY VISION may incur as a result of its activities.

 

Article 6– Personal data

 

The provisions concerning the protection of personal data set forth in the French Data Protection Act of 6 January 1978, as amended and the European Regulation on the protection of personal data of 27 April 2016 which entered into force on 25 May 2018 (“GDPR”) are found in the document attached entitled “Privacy Policy”, accessible on the Website.

 

Article 7 – Amendment and nullity of the contract

 

Should any term of the Contract be, for any reason whatsoever, invalid or unenforceable, the remaining provisions shall not be affected by such invalid or unenforceable provision. 

 

The Parties shall make a good faith effort to replace the enforceable provision by an equivalent one.

 

Amendments to the present Contract shall be made by mutual written agreement of the Parties. 

 

Article 8 Warranties and claims

 

PARIS SEINE ensures the compliance of the Service to the Contract and the Client has the possibility to make a request under the legal warranty of conformity as stipulated in the Section L.217-1-4 and seq of the French Consumer Code or under the legal warranty covering all the consequences of the hidden  or other defects of the goods sold as stipulated in the section 1641 and seq of the French civil code. 

 

This warranty shall cover all apparent or hidden defects detected originating in a defect in design or execution of the services ordered.

 

The Client shall inform PARIS SEINE of these apparent or hidden defects within 48 hours of receiving the services.

 

Possible apparent or hidden defects recorded by PARIS SEINE will give rise to commercial proposal (reimbursement, rectification, credit note) within fifteen (15) days upon the statement of the defect.

 

This warranty is limited to the reimbursement of the services actually paid by the Client. This warranty is excluded in case of delay or inexecution due to a force majeure case as defined in Article 4.

 

Article 9 Governing law and competent courts

 

These TCS are governed and interpreted in accordance with French law, without taking into account conflicts of law.

 

If any provision of these TCS or its application to any person or circumstance is judged null and void, this nullity will not concern the other provisions or applications of these TCS, which will remain in force, independently of the provision judged null and void. To this end, the provisions of these TCS are declared stand-alone.

 

In the event of a dispute arising when interpreting and/or performing these TCS or in relation to these TCS, the User can decide to seek to settle said dispute with the Company through traditional mediation proceedings or any other alternative means of dispute settlement. The User is informed that:

 

To allow a dispute to be examined by the mediator, the User must justify that he has made a written claim to the Company or keep written proof of measures taken;

 

The request must be founded and lawful.

 

The User can bring the matter before the mediator within a maximum period of one year following the Company’s written claim.

 

Finally, in the event that this mediation procedure fails or if the User wishes to bring proceedings, the French Code of Civil Procedure will apply.

 

STRENGTHENED HEALTH PROTOCOL FOR A SAFE AND QUICK DISASTER RECOVERY

 

The following Protocol is established in the context of health crises COVID 19 in order to respond to the pandemic.

Following the government announcements of July 12, 2021, we inform you that as soon as the Health Pass is implemented, we will systematically check the validity of the Health Pass at boarding. No refunds will be given to customers who are not able to present a valid Health Pass (negative PCR test less than 72 hours old or vaccination certificate).

A number of measures has been taken to avoid contamination by the incoming streams (laundry, food products…) and in general, for the whole products delivered to the establishment:

 

  • Normal hygiene measures are respected;
  • Frequency of hand cleaning of the staff has been increased;
  • The AC and the controlled ventilation are regularly checked and cleaned;
  • The delivered products (except fresh products) are cleaned in a specific zone before entering and being stocked in the establishment.
  • Proper, effective surface cleaning and disinfection plan regarding to the locations, the equipment, handles, buttons of doors, railings, and more generally of any object of surface that may have been contaminated (in contact with hands). The cleaning frequency of surface, equipment, supports and utensils has been increased.
  • Hydroalcoholic solution is systematically made available to the clients at the entry of the establishment.
  • The whole staff will be equipped by gloves and masks during the order picking and the service.
  • The bathroom will be disinfected every hour.
  • Social distancing rules for the public will be defined and respected, based on 1 linear meter between two tables. The guests limit by table is 10 persons, forming a homogeneous group (friend, family) predetermined.
  • Spacing measures between people are through posting, road marking, or oral instructions.
  • Public flow organization is managed to limit the crosses.
  • Places or moment of crosses as buffet or banqueting will be avoided or at least framed to avoid the clustering of clients and staff : limitation of the number of clients, onward march, change of cutlery service between each client.
  • Masks are compulsory for clients except when there are eating.
  • Menus will be displayed QR Code or laminated and clean between each handling.
  • Contactless payments (pre-payment, credit transfer, QR CODE..) will be preferred as pay-at-table.

 

This document and the advices about health measures are established on the basis of information available this date from WHO, ministries of health and work, and INRS.

 

It will be amended following the legislative framework and the news measures taken by the managers if necessary.
