These General Terms and Conditions of Sale (hereinafter the ‘GTC’) are offered to Customers (hereinafter the ‘Customer’) by PARIS SEINE, whose registered office is located at 194 rue de Rivoli, 75001 Paris, and which is registered with the Paris Trade and Companies Register under number 400 665 469 (hereinafter ‘PARIS SEINE’).

PARIS SEINE has taken out a general civil liability insurance policy with The Shipowners’ Club, located at 10 Whitechapel High Street, London E1 8QS, United Kingdom.

PARIS SEINE is a company specialising in organising receptions on the Seine for businesses and individuals (hereinafter referred to as the ‘Services’).

 

These GTC govern the contractual relationship (hereinafter the ‘Contract’) between PARIS SEINE and the Customer (hereinafter jointly referred to as the “Parties” and individually as the ‘Party’).

 

These GTC are systematically communicated to each Customer prior to the conclusion of the Contract. Consequently, placing an order for the Services (hereinafter the ‘Order’) implies the Customer’s full and unreserved acceptance of these GTC, to the exclusion of all other documents.

 

The Services offered by PARIS SEINE are intended for consumers as defined by the Consumer Code.

 

It is specified that in accordance with Article L.221-28-12° of the Consumer Code, the right of withdrawal does not apply to Services provided by PARIS SEINE.

 

Article 1 – Booking and payment

 

All Services require prior booking and imply acceptance of these Terms and Conditions.

 

Any booking shall only be considered effective from

  • L’acceptation par PARIS SEINE de la réservation ;

  • La réception d’un mail de confirmation ;

Paris Seine has a fleet of several boats; the service booked does not guarantee a specific boat.

 

Article 2 – Price

 

Prices are firm and final.

Prices include all services indicated in the description of each Service.

The prices quoted are per person, in euros and include all taxes (VAT included).

 

 

The prices mentioned are expressed per Article 3 – Cancellation and modification policy

3.1. Annulation et modification à l’initiative du client

The Customer may cancel all or part of their service, subject to the following conditions:

Any cancellation must be notified to PARIS SEINE in writing. The date of cancellation will determine the cancellation fees applicable, as set out below:

These cancellation fees apply every day of the year.

Mini-cruises

The Customer has the option of renting a small pleasure boat moored at the foot of the NOTI CLUB, 4-6 Port de Suffren, 75015 Paris.

As cruises are subject to the navigation rules for small pleasure boats, MARINA DE BERCY is the sole authority responsible for deciding whether or not the river is navigable.

Pleasure boat cruises may be cancelled, interrupted or modified at any time by MARINA DE BERCY from the moment of booking, including at the time of departure or during the cruise, in accordance with the rules in force, or in the event of bad weather, damage or any other cause that could jeopardise the safety of passengers.

MARINA de BERCY reserves the right to change the port of embarkation. No compensation may be claimed in this regard.

In the event of cancellation of the small boat rental service by MARINA DE BERCY for reasons of force majeure, damage, flooding, bad weather, safety risks and any other circumstances beyond its control as described above, the Customer will be fully reimbursed for the sums paid for the rental of small boats. No compensation may be claimed in this respect.

 

In the event of cancellation of the small boat hire service by the Customer, the Customer will incur charges depending on the date of cancellation:

– 24 hours before the date and time of the service, the customer will not incur any cancellation fees and will be refunded 100%.

– Less than 24 hours before the service, the customer will not be reimbursed. The full amount paid to MARINA DE BERCY will be retained.

-If the customer does not show up on the day, they will be considered a no-show, and MARINA DE BERCY will retain 100% of the service fee.

 

3.1.2. Modification à l’initiative du client

 

Any request for changes must be notified to PARIS SEINE by email to [email protected] at least six (6) hours before the date of the Service.

If the customer does not show up on the day and at the time of their service (lunch or dinner cruise), no refund will be made, which also applies to the Turtle option.
The total amount is payable to Paris Seine.
However, postponement is possible at the customer’s request, subject to the postponement fees set out in Article 3.1.2.
All requests for postponement must be notified to PARIS SEINE at the following email address: :[email protected].

Option Turtle : 

To postpone the Turtle option (bike with driver for two people), a postponement fee will be applied depending on the date on which the customer makes their request:

  • Plus de 72h avant la prestation : possibilité de reporter l’option Turtle gratuitement
  • Entre 72h et 48h avant la prestation : 50% TTC de l’option reste dûe
  • Moins de 48h avant la prestation : Aucun remboursement ne sera effectué

3.2 Annulation à l’initiative de PARIS SEINE

PARIS SEINE reserves the right to cancel the Service at any time in the event of total or partial non-payment. Any deposit received will then be retained.

 

As cruises are subject to navigation rules, PARIS SEINE reserves the right to assess whether or not the river is navigable. Cruises may be cancelled or modified at any time, and the cruise itinerary may be modified after booking, including at the time of departure or during the cruise, in accordance with the rules in force, or in the event of bad weather or any other cause that may jeopardise the safety of passengers.

 

In the event that it is impossible to sail (boat remains docked), PARIS SEINE will grant a fifteen (15) percent discount on the price of the Service.

 

PARIS SEINE also reserves the right to cancel a Service in its entirety, particularly in the event of force majeure, strikes, natural disasters, cultural events, administrative decisions, exceptional closures or any other event beyond its control. Force majeure refers to any event external to the affected party that is unforeseeable, unavoidable and insurmountable, and which prevents PARIS SEINE from fulfilling all or part of its obligations under this Contract.

The amount of the Service will be fully refunded to the Customer, but no additional compensation will be payable.

In the event of total cancellation of the Service, PARIS SEINE shall not be liable for any indirect or collateral damages that may result from such cancellation.

In the event of total cancellation of the Turtle service by Paris Seine, Paris Seine undertakes to refund the full amount paid including VAT (€30).

In the event of cancellation by PARIS SEINE due to force majeure as defined above, the CLIENT shall have the option to postpone their Service within eighteen (18) months of the initial date of the Service, subject to availability.

In the event of total cancellation of the service on 31 December 2024 at the Noti Club restaurant, Paris Seine undertakes to refund the full amount including VAT paid for this dinner. No postponement will be possible.

 

Article 4 – Liability

 

Within the limits provided for by applicable law, PARIS SEINE shall not be held liable for any failure to perform the Contract in the event of force majeure as defined by Article 1218 of the Civil Code and the case law of the French courts, or in the event of damage caused by a third party beyond its control or attributable to misuse or improper use of the Services by the Customer, in violation of PARIS SEINE’s instructions.

Paris Seine hereby informs you that the ‘Turtle’ service chosen by the customer is subject to the following condition:

  • La société Paris Seine agit en tant qu’intermédiaire et ne fournit pas directement la prestation “Turtle” en question. Par conséquent, la société Paris Seine ne peut être tenue responsable des actions, erreurs, omissions ou négligences de tout tiers fournissant ladite prestation “Turtle”.

The quality of the transport service requested through the TURTLE Service is entirely the responsibility of the Driver providing the Service requested by the User. Paris Seine declines all responsibility in connection with the Services with regard to the acts, actions, behaviour, attitudes, and/or negligence of the independent Driver. Any complaints about the Services provided by the independent Driver must therefore be addressed directly to the Driver. In the event of acts, actions, behaviour, attitudes and/or negligence on the part of a Turtle employee Driver, the User may make a complaint to Turtle.

4.1 Objets personnels

 

PARIS SEINE cannot be held liable for the loss or theft of personal belongings or luggage during the Service and cannot undertake to find or return them. All costs incurred in this regard shall be borne by the Customer.

 

4.2 Respect des horaires

 

The Customer must arrive at the boat parking area in full, no later than fifteen (15) minutes before the scheduled departure time. PARIS SEINE will not be able to delay the departure time of the restaurant boat.

 

4.3 Sécurité

 

The Customer undertakes to behave in a manner that does not contravene common sense rules and compliance with applicable laws and regulations.

 

In the context of the COVID-19 health crisis and the resulting pandemic, PARIS SEINE has been required to implement a number of health measures. Details of these measures are set out in the Health Protocol appended to these GTC. This protocol may be subject to change in order to keep pace with developments in the legislative framework and new decisions taken by management.

 

The Customer undertakes to comply with these health measures, the safety rules on board and any instructions that may be given to them by PARIS SEINE and its on-board staff.

 

PARIS SEINE reserves the right to refuse access on board to any person who contravenes these measures/regulations and/or whose behaviour is clearly likely to pose a risk to other Customers, the captain or a third party, without the Customer being entitled to claim compensation or a refund.

 

We would like to remind you that alcohol abuse is hazardous to your health.

 

PARIS SEINE cannot be held liable for the behaviour or accidents of Customers who are intoxicated or under the influence of drugs, or for any damage they may cause.

 

PARIS SEINE reserves the right to charge the Customer for any damage to equipment caused on board by themselves or one of their guests.

 

4.4 Animaux

 

Animals are not permitted on board, with the exception of guide dogs upon presentation of a guide dog card.

 

Article 5 – Insurance

 

PARIS SEINE has an insurance policy covering the financial consequences of civil liability incurred as a result of its activities, with The Shipowners’ Club insurance company located at 10 Whitechapel High Street, London E1 8QS, United Kingdom.

 

Article 6 – Personal data

 

The provisions concerning the protection of personal data as set out in the French Data Protection Act of 6 January 1978, as amended by the Act of 20 June 2018 on the protection of personal data and the European General Data Protection Regulation (‘GDPR’), are set out in an appendix entitled ‘Privacy Policy’.

 

Article 7 – Modification and nullity of the contract

 

In the event that any provision of the Contract is invalidated for any reason, such invalidity shall not affect the validity of the other provisions of the Contract. The Parties shall endeavour in good faith to replace the provision in question with an equivalent clause.

 

Any amendment requires the written agreement of both Parties.

 

Article 8 – Warranty and complaints

 

PARIS SEINE guarantees that the Service complies with the Contract, and the Customer therefore has the option of making a claim under the legal guarantee of conformity provided for in Articles L217-1 et seq. of the French Consumer Code or the guarantee against defects in the item sold within the meaning of Articles 1641 et seq. of the French Civil Code.

 

This warranty covers non-conformities or hidden defects resulting from a design or manufacturing fault in the services ordered.

 

The Customer must notify PARIS SEINE of any defects and/or non-conformities within a maximum period of forty-eight (48) hours from the provision of the services.

 

Any defects and/or hidden defects found by PARIS SEINE will give rise to a commercial proposal (rectification, refund, credit note, etc.) within fifteen (15) days of the defect/hidden defect being identified.

 

PARIS SEINE’s guarantee is limited to the reimbursement of services actually paid for by the Customer. This guarantee is excluded in the event of delay or non-performance resulting from a case of force majeure as defined in Article 4.

 

Article 9 – Applicable law

 

These GTC are governed by and interpreted in accordance with French law, without regard to principles of conflict of laws.

 

If any provision of these GTC or its application to any person or circumstance is deemed invalid, such invalidity shall not affect the other provisions or applications of these GTC, which shall remain in full force and effect, regardless of the provision deemed invalid. To this end, the provisions of these GTC are declared to be independent.

 

In the event of a dispute arising in connection with the interpretation and/or performance of these terms and conditions or in relation to these GTC, the Customer may decide to submit the dispute with PARIS SEINE to conventional mediation or any other alternative dispute resolution procedure.

The Customer is informed that:

 

  • pour que le différend puisse être examiné par le médiateur, le Client devra justifier qu’il a effectué une réclamation écrite faite auprès de PARIS SEINE ou de son service client le et devra garder une preuve écrite des démarches effectuées ;
  • la demande devra être fondée et légitime.
  • le Client pourra saisir le médiateur dans un délai maximum d’un an suivant sa réclamation écrite à PARIS SEINE .

 

Finally, if this mediation procedure fails or if the Customer wishes to take legal action, the rules of the Code of Civil Procedure shall apply.

ENHANCED HEALTH AND SAFETY PROTOCOLS FOR A RAPID AND CONFIDENT RETURN TO WORK

 

This protocol has been drawn up in the context of the COVID-19 health crisis in order to respond to the pandemic within the territory.

Following the government announcements of 12 July 2021, we would like to inform you that as soon as the Health Pass is introduced, we will systematically check the validity of the Health Pass upon boarding. No refunds will be given to customers who are unable to present a valid Health Pass (PCR test less than 72 hours old or vaccination certificate).

A number of measures have therefore been implemented to prevent contamination from incoming goods (laundry, food products, etc.) and, more generally, from all products delivered to the establishment:

 

  • Les règles d’hygiène habituelles sont respectées.
  • La fréquence de nettoyage des mains du personnel est augmentée.
  • Les climatisations et VMC sont régulièrement vérifiés et nettoyées.
  • Les produits livrés (hors frais) sont nettoyés sur une zone dédiée avant de rentrer et d’être stockés dans l’établissement.
  • A également été mis en place un plan de nettoyage et de désinfection des surfaces en fonction des lieux, des équipements de travail, des poignées de portes et boutons, rampes d’escalier, mobiliers matériels et plus généralement de tout objet et surface susceptible d’avoir été contaminé (en contact avec les mains). La fréquence du nettoyage des surfaces, équipements, ustensiles et supports est augmentée par rapport à la normale.
  • Une borne de gel hydroalcoolique est systématiquement mise à disposition de la clientèle dès l’entrée de l’établissement.
  • L’ensemble du personnel sera équipé de gants et masques pendant la préparation et le service.
  • Les sanitaires seront désinfectés toutes les heures.
  • Les règles de distanciation physique au niveau du public (clients, usagers …) seront définies et respectées, basées sur 1 mètre linéaire entre 2 tables de convives constituées. La limite de convives par table est de 10 personnes, formant un groupe de personnes homogène (famille, amis) et préconstitué.
  • Des mesures d’espacement entre les personnes sont précisées par voie d’affichage, marquage au sol et consignes orales.
  • Seules les personnes ayant une place assise peuvent être accueillies dans l’établissement. L’organisation du flux du public est gérée afin de limiter les croisements : limitation du nombre de clients simultanés, sens de circulation pour éviter les croisements de clients.
  • Le port du masque est obligatoire pour les clients sauf lorsqu’ils sont à table.
  • Les menus seront présentés sous forme de QR Code ou plastifiés et nettoyés entre chaque manipulation.
  • Les paiements sans contact sont privilégiés. Tout mode de paiement sans contact (pré-paiement, virement, cartes bancaires, QR code..), et le paiement à table est favorisé.
